CRACKED OR BROKEN SIDEWALKS?

The ultimate goal of the Sidewalk Assessment Program is to improve the sidewalk infrastructure in the City of Elyria for the safety and wellbeing of the residents of the City.  Sidewalk repair and maintenance are the responsibility of the property owner, pursuant to ORC Sections 729.01 and 723.011 and City Codified Ordinance Sections 521.06 and 143.08.   In order to promote the improvement of sidewalk infrastructure, the City provides a program to allow property owners to meet their responsibility through an assessment program that will permit the cost of the repair and / or replacement to be spread over a period of time through the Lorain County Auditor’s Special Assessment process.

In support of this goal, the City of Elyria offers a zero percent (0%) “loan” for the cost of needed repairs or replacements.  In effect, the cost of the sidewalk work performed is certified to the County Auditor’s office in the amount of the loan with no interest.  The property owner enters into an agreement with the City acknowledging that the property owner agrees to pay the cost for the sidewalk work  through a special assessment against said property to be paid with real estate property taxes, distributed over five (5) years.  The amount certified to the County Auditor is the actual cost paid by the City for the work performed.  Additional charges will be added by the County Auditor to process the special assessment.

Participation in the program is voluntary and may be limited due to the funding available in any given budget year. (first come first served)   Maximum loan available per property is $5,000.
